Fish for Charity, Inc. – Participant Liability Waiver &
Release
PLEASE READ CAREFULLY. THIS IS A LEGAL DOCUMENT AFFECTING YOUR
RIGHTS.
By registering for or participating in any event hosted or sponsored by Fish for
Charity, Inc. (“the Organization”), including but not limited to fishing
tournaments, beach cleanups, and waterway cleanup activities (“the
Event”), you agree to the following terms:
1. Acknowledgment of Risks
I understand and acknowledge that participation in the Event involves inherent
risks, including but not limited to:
- Boating hazards, weather, tides, waves, and water conditions
- Slips, trips, falls, or injuries on docks, rocks, jetties, or beaches
- Handling fish, hooks, knives, tools, and other equipment
- Physical exertion associated with cleanup activities
- Encounters with wildlife or marine debris
- Travel to and from Event locations
- Injury, illness, property damage, drowning, or death
I certify that I am physically able to participate and that I will use appropriate
caution.
2. Assumption of Risk
I voluntarily assume all risks, known and unknown, associated with participation in
the Event, even if arising from the negligence of Fish for Charity, Inc., its
officers, directors, employees, volunteers, sponsors, partners, or associated
personnel (“Released Parties”).
3. Release of Liability
In consideration of being permitted to participate, I hereby waive, release, and
forever discharge the Released Parties from any and all claims, demands, causes of
action, losses, or liability of any kind arising out of or related to my
participation in the Event, including those caused by negligence, to the fullest
extent permitted by law.
4. Indemnification
I agree to defend, indemnify, and hold harmless the Released Parties from any claim
brought by me or any third party due to my actions, negligence, or violation of
Event rules or applicable laws.
5. Compliance with Laws and Event Rules
I agree to comply with all Event rules and all local, state, and federal
regulations, including:
- Fishing regulations
- Boating safety laws
- Environmental and cleanup procedures
- Instructions or safety briefings provided by Event organizers
Failure to comply may result in removal from the Event without refund.
6. Medical Release
I authorize the Organization and its volunteers to arrange emergency medical
treatment for me if necessary. I agree that I am solely responsible for any
resulting medical costs.
7. Photography & Media Release
I grant Fish for Charity, Inc. permission to use any photographs, video, or audio
recordings of me for promotional, educational, or fundraising purposes without
compensation.
8. Personal Property
I acknowledge that I am solely responsible for my personal belongings, equipment,
and valuables. The Organization is not responsible for loss, theft, or damage.
9. Donations & Participation Fees –
Non‑Refundable
I understand and agree that all donations, entry fees, participation fees, and
contributions made to Fish for Charity, Inc. are strictly
NON‑REFUNDABLE under any circumstance, including but not
limited to:
- Event cancellation due to weather or unsafe conditions
- Schedule changes
- Inability to attend
- Illness, injury, or emergency
- Disqualification due to rule violations
As a nonprofit organization, all funds are immediately dedicated to charitable
operations, permitting, prizes, staging, safety equipment, and cleanup initiatives.
10. Minor Participants (Under 18 Years Old)
If I am registering or signing on behalf of a minor:
- I certify that I am the minor’s parent or legal guardian.
- I acknowledge that minors carry the same risks described herein.
- I agree that Fish for Charity, Inc. assumes no liability whatsoever for
injuries, damages, losses, or harms to the minor, whether caused by negligence
or otherwise, to the fullest extent permitted by law.
- I voluntarily accept all risks on behalf of the minor and agree to fully
indemnify and hold harmless Fish for Charity, Inc. for any claim brought by or
on behalf of the minor.
By signing for the minor, I am expressly waiving the minor’s right and my right
to sue the Released Parties for any injury or damages occurring during the Event.
11. Governing Law
This waiver is governed by the laws of the State of Florida, without regard to
conflict‑of‑laws rules.
12. Severability
If any provision of this waiver is found invalid or unenforceable, the remaining
provisions shall remain fully enforceable.
13. Acknowledgment of Understanding
I have carefully read this Liability Waiver & Release and fully understand its
contents. I am aware that by agreeing, I am giving up substantial legal rights and
do so freely and voluntarily.
By registering for or participating in any Event hosted by Fish for Charity, Inc., I
agree to all terms of this Liability Waiver & Release.
